Welcome to Level 21 Salon™. These Terms of Use (“Terms”) govern your access to and use of the Level 21 Salon™ website, online forms, rental applications, reservation processes, booking features, communications, and other online services provided through Level 21 Salon™ (collectively, the “Services”).
By accessing or using this website, submitting an application or form, or otherwise using our Services, you acknowledge that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, please do not use the Services.

1. About Level 21 Salon™
Level 21 Salon™ provides professional salon workspace opportunities and related amenities for qualifying independent beauty and grooming professionals.
Available workspace may include barber booths, dedicated braider stations, nail stations, private beauty suites, and other professional workspace or amenities offered by Level 21 Salon™ from time to time.
Descriptions, photographs, amenities, rates, availability, promotional offers, and other information presented on the website are provided for informational purposes and may be updated as the salon develops or operating needs change.

2. Rental Applications
Submitting a rental application does not guarantee approval, acceptance, availability, or reservation of any booth, station, suite, or other workspace.
Level 21 Salon™ reserves the right to review applications and determine whether an applicant meets applicable business, professional, licensing, operational, and salon requirements.
We may request additional information or documentation before making an approval decision.
An application does not create a landlord-tenant relationship, rental agreement, employment relationship, partnership, joint venture, franchise, or other contractual right to occupy a Level 21 Salon™ workspace.

3. Professional Licensing and Legal Compliance
Applicants and renters are responsible for maintaining all licenses, permits, registrations, certifications, insurance, and other credentials legally required to perform their particular services.
Where a Texas professional license is required for a service, the professional must maintain the appropriate active license.
If an applicant indicates that a particular professional license is not required for the services they provide, Level 21 Salon™ may request additional information regarding those services or credentials before approving the application.
Acceptance of an application by Level 21 Salon™ does not constitute a determination or representation that an applicant's services are exempt from any governmental licensing or regulatory requirement.
Each professional remains responsible for complying with all applicable federal, state, and local laws, regulations, health and safety requirements, and professional standards.

4. Workspace Availability and Pricing
Workspace availability is limited and may change at any time.
Prices displayed on the website may vary according to rental type, term, commitment, promotional offer, amenities, availability, or other factors.
Unless expressly stated otherwise in a signed agreement, displaying a price online does not guarantee that price or availability.
Level 21 Salon™ may change future rates, promotions, packages, amenities, or availability. Changes will not override pricing or obligations already established in an executed rental agreement except as permitted by that agreement or applicable law.

5. Pre-Opening and Promotional Offers
Level 21 Salon™ may occasionally provide founding renter, pre-opening, sign-now, introductory, commitment, or other promotional offers.
Promotional offers may be subject to eligibility requirements, availability, deadlines, limited quantities, deposits, executed agreements, or other conditions.
Submitting an application during a promotional period does not automatically secure promotional pricing.
The applicable offer must be confirmed as part of the approved reservation or rental process.

6. Reservations and Payments
Unless otherwise expressly stated in writing, submitting an application does not reserve a workspace.
Approved applicants may be required to complete additional steps to secure a workspace, which may include:
 

• Completing an approved-renter or reservation form;

• Signing a rental agreement electronically;

• Providing required identification or professional documentation;

• Paying required rent, deposits, reservation amounts, or other applicable charges; and

• Completing any other onboarding requirements established by Level 21 Salon™.

A workspace is not considered secured solely because an application has been submitted.
Payment amounts, refundability, deposits, cancellation terms, rent obligations, and other financial terms applicable to a renter will be governed by the applicable offer and executed rental agreement.

7. Rental Agreements Control
These website Terms do not replace a signed rental agreement.
If an applicant is approved and proceeds with a rental, the renter may be required to execute a separate rental, booth, station, suite, or occupancy agreement.
That signed agreement will govern matters including, as applicable, rental rates, deposits, payment schedules, commitment periods, termination, notice requirements, access, equipment, damages, salon rules, defaults, and other rental obligations.
If there is a conflict between these website Terms and an executed rental agreement regarding the rental relationship, the executed rental agreement will control to the extent of that conflict.

8. Independent Professionals
Unless Level 21 Salon™ expressly agrees otherwise in writing, professionals renting workspaces operate their own independent businesses.
A workspace rental does not by itself create an employer-employee relationship between Level 21 Salon™ and the renter.
Independent professionals are responsible for their own clients, services, schedules, taxes, licenses, insurance, products, tools, business practices, and other obligations associated with operating their businesses, except for items expressly provided by Level 21 Salon™ under the applicable rental agreement.

9. Salon Amenities and Equipment
Depending on rental type, Level 21 Salon™ may provide access to certain furniture, fixtures, professional equipment, wash facilities, water, ventilation/exhaust systems, lighting, dryers, televisions, Wi-Fi, laundry services, booking tools, waiting areas, lounges, security features, keyless access, or other amenities.
Not every amenity is necessarily included with every rental type.
Amenities and equipment are subject to applicable salon policies, availability, maintenance, safety requirements, and the renter's executed agreement.
Level 21 Salon™ may temporarily restrict access to equipment or amenities when reasonably necessary for maintenance, repairs, safety, legal compliance, emergencies, or circumstances outside our reasonable control.

10. Turnkey + Customizable Workspaces
Certain Level 21 Salon™ workspaces may be offered as turnkey + customizable.
Renters may be permitted to personalize their workspace with approved décor, branding, products, tools, equipment, or other non-permanent items in accordance with salon policies.
Permanent alterations, construction, painting, mounting, electrical work, plumbing modifications, removal or modification of Level 21 Salon™ equipment, or other material alterations require prior authorization.

11. Access and After-Hours Use
Access privileges vary according to rental type and applicable agreement.
Certain rental types may include approved after-hours access, while others may offer after-hours access as an optional paid feature.
Keyless credentials, access codes, keys, or other access methods are provided only to authorized individuals and may not be shared without permission.
All access remains subject to Level 21 Salon™ safety, security, guest, operating, and access policies.

12. Website Accounts, Forms and Information
You agree to provide accurate, current, and complete information when submitting applications, forms, reservations, or other information through the Services.
You may not impersonate another person, submit fraudulent information, interfere with the website, attempt unauthorized access, introduce malicious software, misuse application systems, or use the Services for unlawful purposes.
Level 21 Salon™ may reject or disregard information reasonably believed to be fraudulent, misleading, abusive, or submitted in violation of these Terms.

13. Electronic Communications
By providing your email address, you consent to receive electronic communications reasonably related to your inquiry, application, reservation, rental process, account, or relationship with Level 21 Salon™.
Electronic communications may include application updates, approval information, rental documents, payment information, operational notices, and other transactional communications.

14. SMS/Text Messaging
Where you separately provide consent to receive SMS/text messages, Level 21 Salon™ may send messages in accordance with the consent presented at the time you opt in.
Messages may include application updates, appointment or reservation information, rental communications, salon updates, and other messages described in the applicable consent.
Message frequency may vary. Message and data rates may apply.
Consent to receive marketing text messages is not a condition of purchasing goods or services where prohibited by applicable law.
You may reply STOP to opt out of applicable text messages and HELP for assistance, subject to the instructions provided with the messaging service.

15. Privacy
Your use of the Services is also subject to the Level 21 Salon™ Privacy Policy.
The Privacy Policy describes how information may be collected, used, maintained, and otherwise handled when you interact with Level 21 Salon™.

16. Intellectual Property
The Level 21 Salon™ name, branding, logos, website design, graphics, text, photographs, videos, software, forms, and other original materials appearing through the Services are owned by or licensed to Level 21 Salon™, except where otherwise indicated.
You may not copy, reproduce, modify, distribute, sell, publish, exploit, or use Level 21 Salon™ intellectual property for commercial purposes without authorization.
Nothing in these Terms transfers ownership of Level 21 Salon™ intellectual property to you.

17. Third-Party Services
The website may use or link to third-party platforms and services, including payment processors, electronic-signature providers, booking systems, communication providers, social-media services, or other technology providers.
Those third-party services may be governed by their own terms and privacy practices.
Level 21 Salon™ is not responsible for the independent operation of third-party websites or services except to the extent required by applicable law.

18. Website Availability and Accuracy
We work to keep information on the website accurate and current, but we do not guarantee that every page, price, description, photograph, availability indicator, or other piece of information will always be error-free or current.
The website may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, or other circumstances.
Level 21 Salon™ may correct errors and update website content when necessary.

19. Limitation of Liability
To the fullest extent permitted by applicable law, Level 21 Salon™ will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of or inability to use the website or online Services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
Additional liability provisions relating to physical salon operations or workspace rental may be contained in the applicable executed rental agreement.

20. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, your material violation of these Terms, or information you knowingly submit fraudulently through the Services.
Any additional indemnification obligations associated with operating an independent business at Level 21 Salon™ will be governed by the applicable rental agreement.

21. Termination or Restriction of Website Access
Level 21 Salon™ may restrict or terminate access to its online Services when reasonably necessary because of fraud, abuse, unlawful activity, security threats, material violations of these Terms, or misuse of the website.
Termination of website access does not automatically modify rights or obligations created under a separately executed rental agreement.

22. Changes to These Terms
Level 21 Salon™ may update these Terms from time to time.
When material changes are made, the updated Terms may be posted on this page with a revised “Last Updated” date.
Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Changes to these website Terms do not retroactively modify an executed rental agreement unless permitted by that agreement and applicable law.

23. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute relating solely to these Terms or use of the Level 21 Salon™ website will be handled in accordance with applicable law and any controlling written agreement between the parties.

24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

25. Entire Website Agreement
These Terms, together with the Level 21 Salon™ Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement governing use of the Level 21 Salon™ website and online Services.
Separate executed rental agreements, reservation agreements, payment authorizations, or other written agreements may create additional obligations between Level 21 Salon™ and an applicant or renter.
